DMCA Policy

Sprunki Retake respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to claims of copyright infringement on our website.

Filing a DMCA Takedown Notice

If you believe that content available on our website infringes your copyright, please send a DMCA takedown notice containing the following information:

  • A physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing, including its location on our website
  • Your contact information (address, telephone number, and email address)
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Counter-Notification

If you believe that your content was removed by mistake or misidentification, you may file a counter-notification containing:

  • Your physical or electronic signature
  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court

Response Time

Upon receipt of a valid DMCA notice, we will remove or disable access to the allegedly infringing material promptly. We will also notify the user who posted the material. If we receive a valid counter-notification, we may restore the material after 10-14 business days unless the copyright owner files a court action.

Repeat Infringers

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. We recommend consulting with legal counsel before filing a DMCA notice or counter-notification.
